Affiliate Marketing Terms and Conditions
Welcome to Quirkey’s Affiliate Program! By joining our program, you agree to abide by these Terms and Conditions, which are designed to ensure a successful partnership between us. This program allows you, as an influencer or affiliate partner (“Influencer”), to earn commissions on sales generated through your unique affiliate link or coupon code provided by Quirkey (“we”, “us”, “our”).
1. Engagement:
As an Influencer, you agree to promote our products, on your social media channels and platforms. You will use the unique affiliate link or coupon code we provide to track the sales generated by your promotions.
2. Commission Structure:
You will earn a commission percentage on net sales (sale price minus discounts and returns) generated through your unique affiliate link or coupon code. Different products and different quantities of items may have different earnings percentages (as per agreement between Quirkey and the influencer)
3. Payment Terms:
Commissions are paid on a monthly or by request basis, within 14 days after the end of each payment period, provided you have reached a minimum threshold of R80.00 in commissions. Payments will be made via EFT.
4. Tracking and Reporting:
You will have access to tracking and reporting tools to monitor your sales and commissions. It is your responsibility to regularly review your account to ensure accuracy.
5. Promotional Materials:
You agree to use our product to create promotional materials (or materials provided by us), in a way that is consistent with your personal branding and audience preferences.
6. Content Guidelines:
All content related to the promotion of our product(s) must be truthful, and comply with applicable regulations. It is the duty of the influencer to comply with platform regulations regarding promotions.
7. Term and Termination:
This agreement is effective until terminated by either party with 14 days written notice. We may terminate the agreement immediately for cause if you breach any of its terms.
8. Confidentiality:
You agree to keep any confidential information received from us in strict confidence and not disclose it to any third parties.
9. Indemnification:
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses arising from your actions or omissions under this agreement.
10. Governing Law:
These terms and conditions are governed by the laws of South Africa.
11. Amendments:
We reserve the right to modify these terms and conditions at any time. Your continued participation in the program following any modifications indicates your acceptance of the changes.
12. Entire Agreement:
These terms and conditions constitute the entire agreement between you and Quirkey regarding the Affiliate Program and supersede all prior agreements and understandings.
By participating in our Affiliate Program, you acknowledge that you have read, understood, and agreed to these terms and conditions.
